Terms and conditions of sale

1. Purpose and scope

These general terms and conditions of sale (the "GTC") govern any order placed by a consumer (B2C) on the website "www.cuberdonsleopold.com" (the "Site"), operated by Confiserie Léopold SRL (the "Seller").

By placing an order, the Customer confirms that they have read the General Terms and Conditions and accept them without reservation, unless there is a prior written agreement from the Seller.

The GTC apply regardless of the location of consultation of the Site. Specific conditions may supplement the GTC for certain services or offers; in case of contradiction, these specific conditions prevail for the relevant offer.

The Seller may modify the GTC at any time. The applicable GTC are those in force at the time of the customer's order validation.

If any provision of the GTC is declared null or unenforceable, the other provisions remain in force.

Terms beginning with a capital letter are defined in the "Definitions" article below.

2. Product information

The Seller describes the products with the utmost care. Photographs and descriptions are provided for informational purposes only. Weights, dimensions, and volumes may vary slightly, and the displayed colours may differ depending on the screens.

3. Prices

The applicable prices are those indicated on the Site at the time of the order. For deliveries within the European Union, prices are shown including VAT, excluding shipping costs. No prices apply outside the European Union as only orders deliverable within the European Union are possible.

In the event of a manifest error in price or shipping costs, the Seller will inform the Customer as soon as possible. The Customer may then cancel the order at no charge.

Order online

The order is reserved for adults (18 years and over) with legal capacity. The ordering process includes the following steps:

  • Choose your product and add it to your ‘shopping cart’;
  • Choose a delivery method;
  • Specify the delivery address;
  • Provide the billing address
  • Provide the payment information;
  • You will be asked to accept the Terms and Conditions;
  • You will be offered the opportunity to review your order summary

After validation, the Customer receives an email confirming receipt of the order. Depending on the payment method, an email regarding the payment status may also be sent. When the order is shipped, a shipping notification is sent to the Customer with a tracking link.

Orders are processed within the limits of available stock. In the event of a product being unavailable after the order, the Seller will inform the Customer and may offer a refund or, if applicable, an alternative solution.

5. Payment

Payment is required at the time of order. The accepted payment methods are those indicated on the Site. The debit is made in the order currency.

6. Formation of the contract

The contract is concluded when payment is received by the Seller (or when it is accepted according to the chosen payment method). Shipping occurs after payment confirmation.

7. Delivery

The Seller only delivers to countries for which delivery is offered on the Site. The communicated timeframes are indicative. The Customer is responsible for the accuracy of the delivery information; any error may result in additional charges.

In case of delay or any questions regarding delivery, the Customer can contact the Seller at the addressorder@confiserieleopold.comby mentioning their order number. If, due to exceptional circumstances, the Seller cannot dispatch the order within 30 days from confirmation, the Customer may cancel the order at no cost and will be refunded.

Delivery is carried out by a professional carrier and a signature may be required. The Customer agrees that the package may be handed over to a person present at the specified address. In case of absence, a new delivery attempt or availability at a pick-up point may be offered depending on the country/region.

Faulty product or incorrect order

Upon receipt, the Customer must check the condition and conformity of the products. In case of any visible issues upon delivery, the Customer is invited to make reservations with the carrier. In all cases, the Customer must inform the Seller within 24 hours by email atorder@confiserieleopold.comstating the order number. In case of an error attributable to the Seller (non-conforming product, preparation error), the Seller will cover the reasonable return costs according to their instructions.

9. Right of withdrawal (distance selling)

In accordance with the rules applicable to distance selling, the Customer has a period of 14 calendar days from the day after delivery to notify the Seller of their decision to withdraw, without reason or penalty. Unless otherwise agreed, the costs and risks of return are the responsibility of the Customer.

The right of withdrawal does not apply, in particular, to goods made to the Customer's specifications or clearly personalised, nor to goods that are likely to deteriorate or expire rapidly (for example: cuberdons). Returns are only accepted for unused products, complete and in their original packaging.

Return procedure (if applicable):

  • Step 1:Contactorder@confiserieleopold.comindicating your order number. The Seller will send you the return instructions by email.
  • Step 2:Carefully pack the unused products and return them, if possible in the original packaging.
  • Step 3:Use the provided return label/ticket and affix it to the parcel according to the instructions.
  • Step 4:Return the products within the time frame indicated by the Seller and, in any case, no later than 14 days following delivery when the withdrawal is exercised.
  • Step 5:After receiving and checking the returned products, the Seller will process the refund within a maximum of 30 days. In the case of an incomplete or damaged return, the Seller will inform the customer.

10. Liability – use of the Site

The Seller makes reasonable efforts to ensure access to the Site, without guaranteeing continuous availability. Unless otherwise required by law, the Seller is not responsible for indirect damages (such as loss of profit) resulting from the use of the Site, nor for interruptions, viruses, or technical incidents beyond its control.

11. External links and use of content

The Site may contain links to third-party sites provided for informational purposes. The Seller has no control over these sites and disclaims any responsibility for their content. Unless prior written permission is obtained, it is prohibited to reproduce, modify, distribute, or commercially exploit all or part of the content of the Site.

12. Suspension / cessation of activities

The Seller may suspend or terminate all or part of its activities and/or access to the Site, particularly for maintenance or if necessary, without this giving rise to any compensation, subject to already paid orders which will be refunded if they cannot be fulfilled.

13. Intellectual property

"Cuberdons Léopold" is a registered trademark, fully and exclusively owned by David Decroix and operated by Confiserie Léopold SRL. Unless authorised, any reproduction, distribution, modification, or use of the Site and its contents for purposes other than personal and non-commercial use is prohibited.

All designs, trademarks, illustrations, images, emblems, accessories, and packaging appearing on the Site or on the products are and remain the exclusive property of the Seller or David Decroix. Their total or partial reproduction, for any reason whatsoever, is strictly prohibited.

14. Personal data – privacy policy

The Seller processes the Client's personal data in accordance with its privacy policy. By using the Site and/or placing an order, the Client consents to the processing of their data for the purposes of managing the client relationship, processing orders, deliveries, invoicing, and, where applicable, marketing communication in accordance with the client's choices.

The Client has the rights provided by applicable regulations (access, rectification, opposition, limitation, etc.). To exercise their rights, they can contact the Seller using the contact details provided on the Site.

15. Definitions

For the purposes of these T&Cs, the following terms have the meanings below:

  • T&Cs:these general terms and conditions of sale and any possible supplements.
  • Order:the purchase request made by the client via the Site according to the ordering process.
  • Seller:Confiserie Léopold SRL, whose operating headquarters is located at Chaussée d’Asse 35, 7850 Enghien and whose registered office is at Stevelberg 52-1541 Pajottegem. VAT BE 0500 922 252.
  • Client:any individual acting for non-professional purposes (consumer) who visits the Site and/or places an order.
  • Payment service provider:Stripe Payments Europe, One Wiltan Park, Wilton Place, Dublin 2, D02 FX04, Ireland. VAT: IE3206488LH.
  • Site:the website "Cuberdons Léopold" which allows for information and online purchase of products.
  • Sale:the distance sale of a product via the Site, delivered to the address provided by the customer.

16. Applicable law and disputes

The general terms and conditions and sales are governed by Belgian law. In the event of a dispute, the courts of Brussels have jurisdiction, subject to the consumer's right to bring the matter before the competent judge based on mandatory legal provisions. The parties accept electronic evidence (including emails and computer records). If any clause is found to be null or unenforceable, the other clauses remain fully in effect.
